What will an EU GDPR Representative do for my organisation?
- The representative acts on behalf of a controller or processor with regard to their obligations, in line with Article 4(17) GDPR.
- The representative maintains your data processing records and reports prepared by you, and makes these records available to the authorities on request.
- The representative supports your business with updates, amendments and new readings of the EU GDPR rules, so you comply with applicable privacy regulations.
Does my company need an EU GDPR Representative?
If your company has no offices, branches or other establishment in the European Union, yet does business with European customers or suppliers, you have to appoint an independent GDPR Representative in the EU. This applies if you process personal data of people in the EU in these contexts:
- you offer goods or services to people in the EU, whether or not payment is required; or
- you monitor the behaviour of individuals in the EU.
In other words: if you are a retailer, service provider or e-commerce company without an EU office but you regularly serve customers in the EU, you need to designate an EU GDPR Representative. This also applies to free services.
