What will an EU GDPR Representative do for my organisation?
- The representative acts on behalf of a controller or processor with regard to their obligations, in line with Article 4(17) GDPR.
- The representative maintains the records of processing activities and reports you have prepared, and makes these available to the supervisory authorities on request.
- The representative keeps your business informed of updates, amendments and new interpretations of the EU GDPR rules, so that you comply with the applicable privacy legislation.
Does my company need an EU GDPR Representative?
If your company has no office, branch or other establishment in the European Union but does business with customers or suppliers in Europe, you must appoint an independent GDPR Representative in the EU. This applies if you process personal data of people in the EU in either of these contexts:
- you offer goods or services to people in the EU, whether or not payment is required; or
- you monitor the behaviour of individuals in the EU.
In other words: if you are a retailer, service provider or e-commerce business without an office in the EU but regularly serve customers in the EU, you need to designate an EU GDPR Representative. This also applies to free services.
Why appoint an EU GDPR Representative?
- A GDPR point of contact and official GDPR mailbox in the EU.
- Efficient cooperation with data protection authorities and customers in the EU.
- Greater convenience for your customers and more trust in your brand.
- Timely updates on EU privacy legislation.
- Full compliance with the EU GDPR.
